Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Akshee Digital Solutions Private Limited, a company incorporated under the Companies Act 2013, with its registered office in Hyderabad, Telangana, India ("meraPA," "we," "us," or "our"). These Terms govern your access to and use of the meraPA mobile application, web application, and all associated services (collectively, the "Service").
By downloading, installing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Service.
1. Eligibility and Account Registration
1.1 Age Requirement. You must be at least 18 years of age to create and operate a meraPA account. meraPA does not provide independent accounts to persons under 18. A parent or legal guardian may create and manage family profiles or information relating to a minor where permitted by applicable law and where the parent or guardian has the necessary authority to do so.
1.2 Account Accuracy. You agree to provide accurate, current, and complete information during registration and to update it promptly if it changes. Providing false or misleading information is grounds for immediate account termination.
1.3 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, PIN, and any biometric authentication configured on your device. You are responsible for all activities that occur under your account. You must notify us immediately at support@merapa.in upon discovering any unauthorised access, breach of security, or suspected compromise of your credentials. meraPA will not be liable for any loss or damage arising from your failure to comply with this obligation.
1.4 One Account Per User. You may not create or operate more than one personal account. Accounts are non-transferable and may not be sold, gifted, or assigned to another person.
1.5 Family Members and Minors. You may add profiles for family members, including your minor children, only if you are their parent or legal guardian or otherwise have lawful authority to act for them. You are responsible for the accuracy and lawfulness of the information you store about them and for obtaining any consent required. meraPA does not provide independent accounts to persons under 18.
2. Description of the Service
2.1 What meraPA Is. meraPA is a personal information management platform designed to help individuals and families securely store, organise, and access important personal data. The Service includes but is not limited to:
- Secure storage and management of personal documents (identity documents, certificates, legal papers)
- Health profile creation and management, including medical history, prescriptions, allergies, diagnoses, lab reports, and vaccination records
- Insurance policy tracking and document storage
- Warranty and product document management
- Emergency QR code generation for rapid information sharing in emergencies
- Optional emergency live-location sharing with your emergency contacts and first responders
- Nominee designation, identity verification (government ID and a live selfie face-match), and controlled data sharing with trusted contacts
- Reminders for medical appointments, insurance renewals, and document expirations
- AI-assisted document scanning, data extraction, and health intelligence features (provided using third-party AI providers, as described in our Privacy Policy)
- Family profile management
- Encrypted cloud storage (AES-256 at rest, TLS 1.3 in transit)
2.2 What meraPA Is Not. The Service is a personal information management tool and is expressly NOT:
- A medical, diagnostic, or clinical service
- A substitute for professional medical advice, diagnosis, or treatment
- An insurance advisory or brokerage service
- A legal or financial advisory service
- An emergency response system
Always contact your local emergency number (for example, 112 in India and across the EU, 911 in the US, 999 in the UK) in a medical or life-threatening emergency. The Emergency QR code and emergency live-location feature are convenience tools to assist a person helping you in an emergency — they are not a medical device and do not replace emergency medical care.
2.3 AI Features. Certain features use artificial intelligence to extract data from documents, generate health summaries, and provide insights. These outputs are for informational purposes only, may contain errors, and should not be relied upon as medical, legal, insurance, or financial advice. Always verify AI-generated information with a qualified professional.
2.4 Service Availability. We strive to maintain high availability but do not guarantee uninterrupted, error-free, or completely secure access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
2.5 Third-Party and International Processing. To provide the Service, meraPA relies on third-party sub-processors, some of which process certain data outside India under appropriate contractual safeguards. This includes AI providers that analyse the documents and health information you submit. The providers, the data they receive, and where they operate are described in our Privacy Policy.
2.6 No Professional Relationship. Use of meraPA does not create a doctor-patient, lawyer-client, financial-adviser-client, insurance-adviser-client, fiduciary, emergency-response or other professional relationship between you and meraPA.
3. Subscriptions and Billing
3.1 Free Plan. meraPA offers a Basic free tier with limited storage and features. Access to premium features requires a paid subscription.
3.2 Paid Subscriptions. Paid plans are billed in the currency shown at checkout, inclusive of applicable taxes. Current pricing is displayed in the application. We may change pricing from time to time. For existing subscribers, any price change will apply to a future renewal, and we will provide any notice required by applicable law and, where appropriate, reasonable advance notice.
3.3 Introductory Pricing. Any introductory or promotional pricing applies only to the initial billing period stated at the time of purchase. Renewals will be charged at the standard rate then in effect.
3.4 Automatic Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You will receive a renewal reminder before the charge. Automatic renewal is subject to the requirements of applicable consumer-protection laws and the policies of the platform through which you purchased the subscription. Where required by law, we will provide the applicable renewal disclosures, reminders and cancellation mechanisms.
3.5 Cancellation. You may cancel your subscription at any time from within the application or by contacting support@merapa.in. Upon cancellation, your subscription remains active until the end of the current paid billing period. No partial refunds are provided for unused time within a billing period, except as stated in Section 3.6. If your subscription was purchased through Apple, Google Play or another third-party platform, cancellation and refund procedures may also be governed by that platform's terms and policies.
3.6 Refund Policy. Unless otherwise stated at the time of purchase or required by applicable law, you may request a full refund within 14 days of your initial subscription purchase by contacting support@merapa.in. This 14-day refund is a meraPA policy and does not limit any mandatory cancellation, withdrawal or refund rights available to you under the laws of your country or through the platform used to purchase the subscription. Refunds for renewal charges are generally not provided except where required by applicable law or the applicable payment platform's policies. Approved refunds will be credited to the original payment method within 7–10 business days.
3.7 Downgrade on Expiry. If your paid subscription expires without renewal, your account automatically reverts to the free Basic plan. Your data is not deleted on downgrade — you retain access to view and export all existing data. If your stored data exceeds the Basic plan's storage limit, you can continue to view and export it but cannot add new uploads until you free up space or upgrade again.
3.8 Failed Payments. If a payment fails, we will notify you and attempt to charge again. If payment remains unsuccessful, your subscription may be downgraded to the Basic plan. You remain responsible for any outstanding amounts.
3.9 Taxes. All prices are shown inclusive of applicable taxes (such as GST or VAT) where applicable. You are responsible for any other taxes or charges applicable in your jurisdiction.
4. Acceptable Use Policy
4.1 Permitted Use. You may use the Service solely for your personal, non-commercial use and for managing information pertaining to yourself and family members for whom you have lawful authority to act.
4.2 Prohibited Activities. You agree not to:
- Upload, store, or share content that is false, fraudulent, misleading, defamatory, obscene, or that infringes the intellectual property rights of any third party
- Store or transmit any material that is illegal under any applicable law
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Service for any commercial purpose, including data resale, bulk data collection, or advertising
- Attempt to gain unauthorised access to any portion of the Service, other accounts, or connected systems
- Reverse engineer, disassemble, or decompile any part of the application
- Circumvent, disable, or interfere with any security feature, authentication mechanism, or encryption
- Introduce any virus, worm, ransomware, or other malicious code
- Use automated tools, bots, or scrapers to access or interact with the Service
- Add, upload, or share another person's personal information without the authority or permissions required by applicable law
- Use the Emergency QR feature to share false or misleading medical information
- Scan another person's Emergency QR other than to assist in a genuine emergency, or misuse any information obtained through it
4.3 Consequences of Violation. Violation of this policy may result in immediate suspension or termination of your account without refund, and may expose you to civil and/or criminal liability.
5. Your Content and Data
5.1 Ownership. You retain full ownership of all documents, data, and content you upload or create within the Service ("User Content"). These Terms do not transfer any ownership rights to meraPA.
5.2 Licence to meraPA. By uploading User Content, you grant meraPA a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely to the extent necessary to provide the Service to you, including processing by the third-party sub-processors described in our Privacy Policy. This licence ends when you delete the relevant User Content or close your account, except to the extent processing remains necessary for account deletion, backup and disaster recovery processes, security, fraud prevention, legal compliance, dispute resolution, or other purposes permitted by applicable law.
5.3 Data Accuracy. You are solely responsible for the accuracy, completeness, and legality of all User Content you upload. Errors in stored health or emergency information could have serious consequences — please ensure your data is current and accurate.
5.4 Data Export. You may export a copy of your data at any time from within the application in JSON or PDF format.
5.5 Data Deletion. You may delete individual records or your entire account at any time. Account deletion permanently removes all your data from our active systems within 30 days. De-identified, aggregated data may be retained for analytical purposes.
5.6 Storage Limits. Each plan tier has defined cloud storage limits. Exceeding your limit will prevent new uploads until space is freed or your plan is upgraded.
6. Nominees, Data Sharing and Emergency Features
6.1 Nominee Designation. meraPA allows you to designate trusted individuals ("Nominees") to access specific categories of your data in defined circumstances.
6.2 Your Responsibility. By designating a Nominee, you confirm that you have the lawful authority to provide the information you submit about that person and to configure the permissions you grant. Where applicable law requires the Nominee's consent or authorisation, you are responsible for obtaining it.
6.3 Nominee Identity Verification. To reduce misuse, a Nominee may be asked to verify their identity by providing a government ID and a live selfie for a face-match check. By adding a Nominee, you acknowledge this verification may take place.
6.4 meraPA's Role. meraPA acts solely as a conduit to facilitate data sharing. meraPA is not responsible for any actions taken by Nominees, disputes between you and your Nominees, or consequences arising from incorrect data shared with Nominees.
6.5 Emergency QR Access. The Emergency QR displays a subset of your health information to anyone who scans it. You are solely responsible for the content you enable for Emergency QR display.
6.6 Emergency Live Location. If you enable emergency live-location sharing, meraPA can make your device's real-time location available to your emergency contacts and to authorised emergency-access recipients (for example, a person who scans your Emergency QR to assist you) during an active emergency. This feature is optional, requires your consent and your device's location permission, and runs only for the duration of the emergency (stopping automatically after two hours or when you cancel it). meraPA does not track your location during normal use, and does not transmit your location directly to public emergency services or first-responder dispatch systems. Because location sharing depends on your device, its settings, and network connectivity, meraPA cannot guarantee that your location will be available or accurate in any given emergency.
6.7 Data Collected From Emergency Scanners. When a person scans your Emergency QR, meraPA collects information about that person — including a verified phone number, location, and, for hospital-level access, a photo — to confirm a genuine emergency, log the access, notify you, and prevent misuse, as described in our Privacy Policy. When you scan another person's Emergency QR, information may be processed as described in our Privacy Policy for security, emergency-access verification, access logging and misuse prevention. You should use Emergency QR information only for a genuine emergency or other purpose authorised by the person who made the information available. Misuse of Emergency QR information may result in blocking, termination of access and, where applicable, legal consequences.
6.8 Emergency Information. Emergency QR and related emergency features depend on the information you have chosen to provide, the availability of the Service, device functionality, network connectivity and the configuration of your account. You remain responsible for ensuring that emergency information is accurate and current. meraPA does not guarantee that an emergency recipient will access, read, understand or act upon the information.
7. Privacy and Data Protection
7.1 Privacy Policy. Our collection, use, and protection of your personal data is governed by our Privacy Policy available at merapa.in/privacy, incorporated into these Terms by reference.
7.2 Your Data-Protection Rights. Depending on the law applicable to you, you may have rights to access, correct, erase or otherwise control your personal data, including the right to withdraw consent where processing is based on consent, as described in our Privacy Policy. These rights are provided under applicable data-protection laws — including India's Digital Personal Data Protection Act 2023, the EU and UK GDPR, and applicable U.S. state privacy laws. Requests may be submitted via the application or to privacy@merapa.in.
7.3 Security. We implement AES-256 encryption at rest (envelope encryption with a unique key for each user), TLS 1.3 in transit, and biometric / PIN app-lock in addition to OTP-verified login. No method of electronic storage is 100% secure and we cannot guarantee absolute security.
7.4 Data Location. Your data is primarily stored in India. Some features rely on trusted service providers that process certain data outside India under appropriate contractual safeguards, as described in our Privacy Policy.
8. Intellectual Property
8.1 meraPA Ownership. The Service, including its software, design, algorithms, trademarks, and all content created by meraPA, is the exclusive intellectual property of Akshee Digital Solutions Private Limited.
8.2 Licence to You. Subject to your compliance with these Terms, meraPA grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service on your personal devices for your personal use.
8.3 Restrictions. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our express written consent.
8.4 Feedback. If you provide suggestions or feedback about the Service, you grant us a perpetual, royalty-free licence to use and incorporate such feedback without any obligation to you.
9. Third-Party Services
9.1 The Service integrates with third-party providers for cloud infrastructure, AI processing, identity verification, payment processing, SMS/WhatsApp notifications, voice calls, push notifications, mapping, and email delivery. These providers are subject to their own terms and privacy policies.
9.2 Payment transactions are processed by third-party payment gateways. meraPA does not store your full payment card details.
9.3 References to third-party services do not constitute an endorsement by meraPA.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED ACCESS. meraPA DOES NOT WARRANT THAT AI-GENERATED INSIGHTS WILL BE ACCURATE, THAT THE EMERGENCY QR OR EMERGENCY LIVE LOCATION WILL BE ACCESSIBLE OR ACCURATE IN ANY GIVEN EMERGENCY, OR THAT DATA STORED WILL NEVER BE LOST OR COMPROMISED. ALWAYS MAINTAIN INDEPENDENT COPIES OF CRITICAL DOCUMENTS.
Some jurisdictions do not allow the exclusion of implied warranties or statutory consumer guarantees; to the extent those laws apply to you, the above exclusions apply only to the maximum extent permitted by law, and nothing in these Terms limits any mandatory consumer rights you have under the law of your country of residence.
11. Limitation of Liability
11.1 meraPA's total aggregate liability to you for any claims shall not exceed the total amount you paid to meraPA in the twelve months preceding the event, or the equivalent of INR 1,000 in the currency of your purchase, whichever is greater.
11.2 meraPA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, even if advised of the possibility of such damages.
11.3 Nothing in these Terms limits meraPA's liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of any statutory consumer guarantee or right that cannot be excluded, or for any other liability that cannot be excluded under applicable law.
11.4 Nothing in this Section limits meraPA's liability to the extent such limitation or exclusion is prohibited by applicable law.
12. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Akshee Digital Solutions Private Limited and its officers, directors, employees and agents from third-party claims, liabilities and reasonable expenses arising directly from your unlawful use of the Service, your violation of these Terms, or your User Content that infringes another person's rights. This obligation does not apply to the extent a claim results from meraPA's own negligence, wilful misconduct or breach of applicable law.
13. Account Suspension and Termination
13.1 By You. You may close your account at any time from within the application, initiating data deletion as described in Section 5.5.
13.2 By meraPA. We may suspend or terminate your account immediately without notice or refund if you have violated these Terms, engaged in fraudulent activity, or if continued access poses a risk to the Service or other users.
13.3 Provisions that by their nature should survive termination — including Sections 5.1, 8, 10, 11, 12, and 14 — shall survive.
14. Changes to These Terms
We may modify these Terms from time to time. Where required by applicable law, we will provide notice of material changes before they take effect and obtain any required consent. Where permitted by law, continued use of the Service after the effective date of revised Terms constitutes acceptance of those revised Terms.
15. Grievance Redressal / Complaints
For users in India, complaints and grievances may be submitted to our Grievance Officer. Where applicable, meraPA will handle grievances in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the applicable Rules and other applicable law, taking into account the commencement dates of the relevant provisions.

If you are located elsewhere, you may contact us at privacy@merapa.in and we will respond within the period required by the law applicable to you. You may also have the right to escalate an unresolved complaint to your local data-protection or consumer-protection authority.
16. Governing Law and Dispute Resolution
16.1 These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Where you use the Service as a consumer in another country, this does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence.
16.2 Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act 1996, by a sole arbitrator seated in Hyderabad, Telangana, India, conducted in English. This arbitration agreement does not apply where, and to the extent that, mandatory law applicable to you as a consumer gives you the right to bring or defend proceedings in the courts of your country of residence, or otherwise prohibits pre-dispute arbitration; in that case those rights are preserved.
16.3 Subject to Sections 16.1 and 16.2, and to any non-waivable right you have to bring proceedings in your local courts, you submit to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
17. General Provisions
17.1 These Terms constitute the entire agreement between you and meraPA with respect to the Service.
17.2 If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
17.3 Our failure to enforce any right shall not constitute a waiver of that right.
17.4 You may not assign your rights under these Terms without our prior written consent. meraPA may assign its rights without restriction.
17.5 meraPA shall not be liable for failure or delay due to causes beyond our reasonable control, including natural disasters, acts of government, or internet failures.
17.6 These Terms are written in English. In the event of conflict between translated versions, the English version prevails.
